Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
